Trans vaginal Mesh Patch- History of the Transvaginal mesh
Between the years of 2005 and 2010, almost 4,000 vaginal mesh injuries have been reported to the Food and Drug Administration. In a 2010 article in the journal of Obstetrics & Gynecology, researchers stated that manufacturers had to cease a vaginal mesh clinical trial early because of the high number of vaginal mesh complications and injuries. This vaginal mesh trial was stopped when it was discovered that more than 15 percent of women who were implanted with a vaginal mesh suffered vaginal mesh erosion within three months of implantation. In 2011, the FDA issued a vaginal mesh warning to patients and physicians due to reports of transvaginal mesh complications. in 2011, the FDA cautioned that the risks of using the vaginal mesh patch are so severe that alternative treatments should be considered. It is now widely accepted that, in most cases, pelvic organ prolapse can be treated without the use of a trans vaginal mesh.
Sept 8 2011.
The Food and Drug Administration plans to hold a subcommittee meeting to discuss "the safety and effectiveness of transvaginal surgical mesh for repair of pelvic organ prolapse" this week on September 8 and 9. This meeting comes at a time when consumer groups are calling for the widespread recall of surgical mesh due to severe complications.
Last week, during the meeting of the FDA Obstetrics and Gynecology Devices Advisory Committee in Maryland, the Committee indicated that they would support premarket testing of these devices.

Statute of Limitations for Vaginal Mesh lawsuits
It is different in different states. Florida has what is called the discovery rule which essentially starts the statute when you know that you are injured and that the injury is probably caused by someone’s negligence. Not all states have discovery rule and the statute, according to some vaginal mesh lawyers, will run from the date that the injury occurred (implantation or when the mesh started causing problems).
The year 2008 is important as that is when the FDA warning was issued. When was your mesh implanted ? When did you start having symptoms? When was your mesh implanted? All these are questions that need to be considered. Vaginal mesh lawyers may argue that the warning and associated press was not sufficient to put a person on notice of the relationship between the mesh and the injury. Heck some doctors are still telling women that it is not the mesh causing problems but something else (like a tumor) Some doctors are still using the Mesh even after the 2008 warning.
In short, according to many vaginal mesh lawyers, each case will rise and fall on its own and will be dependent on each individual state. It is important to retain a lawyer who will take your case on an indivdual Multi District Litigation basis and who is willing to fight for your particular situation. Lawsuit Update: The Multi District Litigations for vaginal mesh lawsuits have been consolidated in only a few states. The consolidation means the appropriate jurisdiction for the MDL is based on the manufacturer in your case. The case will not necessarily remain in your home state if the MDL jurisdiction for the manufacturer of your mesh is not the state you had the vaginal mesh implanted in. Many locally filed cases will be moved and consolidated to the state where the juridisdiction was decided by the MDL panel of judges. You will not have to travel to the location of the MDL. The statute of limitations is running close for many states. All Vaginal Mesh cases are on a contingency basis. Johnson and Johnson has just announced they are removing four of their Gynacare products from the market and a label change for still another. This is an important new update for the Mesh lawsuits. This is not an announced recall but, it is a withdrawel of a product and a a change for the implantation of the mesh to be restricted to surgical implantation thru the abdomin only . This date is important to the Vaginal Mesh lawsuits. For further information as to how this effects you and the statue of limitations for your state speak to a Vaginal Mesh Helpline lawyer today.
