Georgia Child Custody and Child Support Laws have changed in recent years and there are new rules you should be aware of to avoid mistakes some people make regarding the welfare of children. 1. When either spouse moves out of the home, or the children are in your care, file for child support and child care immediately.
2. Each parent is responsible for a share of the child support, and the party who does not have custody of the children pays his or her share. Both parents' incomes go into a formula, along with adjustments for parenting time, insurance paid, educational and extra-curricular expenses, other children in the household, other child support paid, and other items.
3. Georgia Child Support Laws changed in 2008. Effective Jan. 1, 2008, Georgia Law require that parents have a parenting plan regarding day to day decisions, emergency decisions, parent access to health and education records as well as information regarding extra-curricular activities and religious communications.
4. Child Support beyond age 18. The court cannot order parents to pay for a child's college education however: it should be agreed to by both parents during the divorce process because afterwards one parent may not agree.
